Five Strategies that Ensure a Change-the-Business ADM Model ...

ISG logoWhile cost savings remains a top priority for global Application Development and Maintenance (ADM) organizations, businesses are also increasingly looking to shift from a ?Run the Business? model to a ?Change the Business? (CtB) perspective, whereby ADM resources are focused on enabling transformational enterprise-wide initiatives, rather than merely supporting the status quo and reacting to small enhancements.

The demands associated with a CtB approach, however, can increase the risk of higher defect rates and maintenance costs, as well as poor documentation and weak standards around performance and process measures.

Here are five key strategies to ensuring that a CtB ADM model is implemented with optimal efficiency.

  1. Separate and manage service categories. Delineation of the major categories of ADM is essential to efficient management. As the old adage goes, you can?t manage what you can?t measure ? it is imperative for organizations to understand their application support costs.? Specifically, you need to define three main categories ? Maintenance, Minor Enhancement, and Project-Based Work ? and manage costs of each of those categories separately. The reason is that cost drivers and performance indicators vary by category, so different actions and priorities may be required for each.
  2. Align the retained organization with the strategy. Many ADM organizations fall into the trap of focusing on what they can do, rather than what the business needs. For a CtB strategy, that?s a recipe for disaster. Key roles and attributes to help ensure that ADM activity stays on track include liaisons whose specific role is to coordinate between business and IT leaders; program/project managers to oversee large programs; client-driven architecture; ongoing business analysis to understand and communicate business needs; service delivery managers; and business subject matter experts to work with developers and testers.
  3. Define end-to-end Service Level Agreements. Multi-supplier environments are the norm in today?s outsourcing environment.? The multi-supplier environment provides significant advantages to clients, but also introduces complexities when trying to govern a large outsourcing arrangement or manage a large software development program.? Service Level Agreements are an effective way to incent the right behaviors in a multi-supplier environment, but they must be built to address the entire project lifecycle and clearly aligned with the responsibilities of the suppliers.
  4. Embrace process excellence. Service Levels and quality goals are often aligned with process maturity ? and more mature organizations can be contractually obligated to deliver higher quality code.? Since process adherence drives repeatability and productivity improvements, service providers should be incented to operate at CMMi Level 3 or higher, and to commit to productivity improvements.? Conduct on-going operational assessments to ensure process adherence.
  5. Use Key Performance Indicators (KPIs) and dashboards. Gauge performance on an ongoing basis with tools such as an Earned Value Analysis (EVA) that includes a schedule and cost performance index.? To stay on top of defects, employ other quality metrics such as:
  • Defect injection and probability statistics for software quality
  • Structural Quality tools and techniques to validate the longer term supportability of the code
  • Regression testing, defect detection, and effective test coverage ratios to validate the functional quality of the deliverables

These three simple suggestions, if done in a timely manner, can improve your home dramatically. 6 interesting technology law issues raised in the ... - Internet Cases

Patent trolls, open source, do not track, SOPA, PIPA and much, much more: Facebook?s IPO filing has a real zoo of issues.

The securities laws require that companies going public identify risk factors that could adversely affect the company?s stock. Facebook?s S-1 filing, which it sent to the SEC today, identified almost 40 such factors. A number of these risks are examples of technology law issues that almost any internet company would face, particularly companies whose product is the users.

(1) Advertising regulation. In providing detail about the nature of this risk, Facebook mentions ?adverse legal developments relating to advertising, including legislative and regulatory developments? and ?the impact of new technologies that could block or obscure the display of our ads and other commercial content.? Facebook is likely concerned about the various technological and legal restrictions on online behavioral advertising, whether in the form of mandatory opportunities for users to opt-out of data collection or or the more aggressive ?do not track? idea. The value of the advertising is of course tied to its effectiveness, and any technological, regulatory or legislative measures to enhance user privacy is a risk to Facebook?s revenue.

(2) Data security. No one knows exactly how much information Facebook has about its users. Not only does it have all the content uploaded by its 845 million users, it has the information that could be gleaned from the staggering 100 billion friendships among those users. [More stats] A data breach puts Facebook at risk of a PR backlash, regulatory investigations from the FTC, and civil liability to its users for negligence and other causes of action. But Facebook would not be left without remedy, having in its arsenal civil actions under the Computer Fraud and Abuse Act and the Stored Communications Act (among other laws) against the perpetrators. It is also likely the federal government would step in to enforce the criminal provisions of these acts as well.

(3) Changing laws. The section of the S-1 discussing this risk factor provides a laundry list of the various issues that online businesses face. Among them: user privacy, rights of publicity, data protection, intellectual property, electronic contracts, competition, protection of minors, consumer protection, taxation, and online payment services. Facebook is understandably concerned that changes to any of these areas of the law, anywhere in the world, could make doing business more expensive or, even worse, make parts of the service unlawful. Though not mentioned by name here, SOPA, PIPA, and do-not-track legislation are clearly in Facebook?s mind when it notes that ?there have been a number of recent legislative proposals in the United States . . . that would impose new obligations in areas such as privacy and liability for copyright infringement by third parties.?

(4) Intellectual property protection. The company begins its discussion of this risk with a few obvious observations, namely, how the company may be adversely affected if it is unable to secure trademark, copyright or patent registration for its various intellectual property assets. Later in the disclosure, though, Facebook says some really interesting things about open source:

As a result of our open source contributions and the use of open source in our products, we may license or be required to license innovations that turn out to be material to our business and may also be exposed to increased litigation risk. If the protection of our proprietary rights is inadequate to prevent unauthorized use or appropriation by third parties, the value of our brand and other intangible assets may be diminished and competitors may be able to more effectively mimic our service and methods of operations.

(5) Patent troll lawsuits. Facebook notes that internet and technology companies ?frequently enter into litigation based on allegations of infringement, misappropriation, or other violations of intellectual property or other rights.? But it goes on to give special attention to those ?non-practicing entities? (read: patent trolls) ?that own patents and other intellectual property rights,? which ?often attempt to aggressively assert their rights in order to extract value from technology companies.? Facebook believes that as its profile continues to rise, especially in the glory of its IPO, it will increasingly become the target of patent trolls. For now it does not seem worried: ?[W]e do not believe that the final outcome of intellectual property claims that we currently face will have a material adverse effect on our business.? Instead, those endeavors are a suck on resources: ?[D]efending patent and other intellectual property claims is costly and can impose a significant burden on management and employees?.? And there is also the risk that these lawsuits might turn out badly, and Facebook would have to pay judgments, get licenses, or develop workarounds.

(6) Tort liability for user-generated content. Facebook acknowledges that it faces, and will face, claims relating to information that is published or made available on the site by its users, including claims concerning defamation, intellectual property rights, rights of publicity and privacy, and personal injury torts. Though it does not specifically mention the robust immunity from liability over third party content provided by 47 U.S.C. 230, Facebook indicates a certain confidence in the protections afforded by U.S. law from tort liability. It is the international scene that gives Facebook concern here: ?This risk is enhanced in certain jurisdictions outside the United States where our protection from liability for third-party actions may be unclear and where we may be less protected under local laws than we are in the United States.?

You have to hand it to the teams of professionals who have put together Facebook?s IPO filing. I suppose the billions of dollars at stake can serve as a motivation for thoroughness. In any event, the well-articulated discussion of these risks in the S-1 is an interesting read, and can serve to guide the many lesser-valued companies out there.

Apple engineers ?heavy into? near-field communication for iPhone 5, rumor says (Appolicious)

Near-field communication seems poised to be the next major technology to sweep the smartphone market. Already there are smartphones running Google?s Android operating system that contain the technology, and we recently heard about a chip embedded in a smartphone case that brings the capability to any current iPhone.

But with the iPhone 5, you might not need an external chip hidden in a smartphone case. Rumor has it, Apple is working hard on bringing NFC to the next iPhone, expected to drop this summer.

A little background for the unfamiliar: near-field communication is a short-range broadcast technology that would allow your smartphone to interact with other devices when you hold them close together. The major use for the tech right now is for completing transactions in brick-and-mortar stores: imagine inputting all your credit card information (as well as loyalty cards and anything else relevant to the store you?re in) into your phone, then just waving it in front of a terminal at a store. Many stores already include Pay Pass terminals, which include the same tech, and the credit card ?wallet? system describes the Google Wallet system the company announced last year.

According to a story from 9to5Mac, an unidentified high-ranking app developer told the site at Macworld that Apple?s engineers are hard at work on NFC technology, presumably to work it into the iPhone 5 ? and that he was confident enough to bet app development on it. That make sense in a lot of ways, given that NFC seems ready to break out, with merchants embracing the technology (or similar, smartphone-related payment methods), terminals readily available and mobile payment methods provided by credit card companies, Google and others.

Apple usually likes to wait for a technology to be mature and reliable before implementing it, as well as make sense for its users. NFC makes sense under those criteria, especially given the move among many smartphone owners to make use of their phones to pay for things. Already, Starbucks stores are seeing heavy use of the company?s mobile app, which allows users to use the screens of their iPhones in place of a Starbucks card; scanning the barcode on the screen can be used to pay for the transaction in-store. PayPal is currently testing a similar app-driven system in Home Depot stores.

There are still hurdles to be worked out for NFC payment programs, though. Apple will likely find a partner (as 9to5Mac reports, Pay Pass seems likely) for its service, but it?ll also need the cooperation of its carriers. Over in the Google camp, Verizon has blocked Google Wallet in favor of ISIS, its own NFC wallet tech. So though the beginning of the NFC road could be waiting for iOS users in June, how long it?ll be before we?re swiping our smartphones to pay for groceries isn?t yet clear.

Nixon clarifies: 'Bisexuality is not a choice'

Cynthia Nixon, who shaved her head for her new Broadway role, is now clarifying her earlier statement that she believed being gay is a choice.

Cynthia Nixon is backtracking on her controversial "being gay is a choice" interview, which landed her in hot water with the gay community last week.

The "Sex and the Cit"y alum issued a new statement to the Advocate today after recently telling the New York Times Magazine that, for her, homosexuality "is a choice."

"My recent comments in The New York Times were about me and my personal story of being gay," Nixon told the Advocate. "I believe we all have different ways we came to the gay community and we can't and shouldn't be pigeon-holed into one cultural narrative which can be uninclusive and disempowering. However, to the extent that anyone wishes to interpret my words in a strictly legal context I would like to clarify:

"While I don't often use the word, the technically precise term for my orientation is bisexual. I believe bisexuality is not a choice, it is a fact. What I have 'chosen' is to be in a gay relationship.

"As I said in the Times and will say again here, I do, however, believe that most members of our community -- as well as the majority of heterosexuals -- cannot and do not choose the gender of the persons with whom they seek to have intimate relationships because, unlike me, they are only attracted to one sex.

"Our community is not a monolith, thank goodness, any more than America itself is. I look forward to and will continue to work toward the day when America recognizes all of us as full and equal citizens."
